Steel major Tata Steel on Friday (January 17) said it has filed a curative petition with the Supreme Court of India today (January 17), seeking the invocation of extraordinary jurisdiction concerning the tax imposition on its mineral-bearing land in Odisha.

“…we wish to inform you that, the company has today i.e., January 17, 2025, filed Curative Petition before the Hon’ble Supreme Court of India praying invocation of extraordinary jurisdiction of the Hon’ble Supreme Court of India under order XLVIII, Rule 1 of the Supreme Court Rules, 2013 in respect of the order dated September 24, 2024, passed by the Constitutional Bench of the Hon’ble Supreme Court of India in Karnataka Iron & Steel Manufacturers Association vs. Mineral Area Development Authority & Another,” Tata Steel said in a regulatory filing.
The company’s petition challenges the Supreme Court’s September 24, 2024, order dismissing a batch of review petitions related to the constitutional validity of the tax imposed under the Orissa Rural Infrastructure and Socio-Economic Development Act, 2004.

The issue dates back to the constitutional Bench ruling on July 25, 2024, which upheld the authority of the state to levy taxes on mineral rights under the Mines and Minerals (Development & Regulation) Act, of 1957. The court’s decision clarified that the Mines and Minerals Act does not strip the state’s power to impose taxes on mineral-bearing land, a significant ruling for the industry.
Following this, the constitutional Bench issued further clarifications on August 14, 2024, detailing aspects of its initial judgment, which left some matters open for review. Subsequently, the company sought review petitions, but the Supreme Court dismissed these petitions on September 24, 2024.
In continuation of its earlier disclosures, Tata Steel has now approached the Supreme Court again with the curative petition, which represents the final legal recourse for the company. The petition seeks the court’s extraordinary jurisdiction to reconsider the order dismissing the review petitions.

Shares of Tata Steel Ltd ended at ₹130.30, up by ₹2.50, or 1.96%, on the BSE.
